汪楠の判決について ※English below
１１月５日、汪楠に懲役１３年の判決が言い渡されました。
池袋のマンションで発生した強盗致傷事件における指示役として、実行犯の最も重い刑と同等の刑が科されました。
汪楠は逮捕後２年間、一貫して事件への関与を否認しています。
逮捕当時、警察は複数のカメラが並ぶ前で、２階の窓ガラスを割って自宅に押し入り、連行しました。
汪楠は否認した為に、「人質司法」により、公判終了までの２年間に渡り独房に拘留され、家族を含め弁護人以外の者との一切の面会はもちろん、手紙のやり取りさえ認めない全面接見禁止がつき、精神的に追い詰める措置が取られました。
公判では４名の実行犯が証人として出廷しましたが、汪楠の関与を示唆したのはそのうち1名のみで、他の３名は関与を否定または認知していませんでした。判決文は、この１名の証言を主な根拠として構成され、他の証言や別の可能性については十分に検討されていません。
捜査当局は、汪楠の名前が浮上した時点で事件の全体像を「汪楠を中心とする計画的犯行」として断定し、他の角度からの捜査を行わなかったことが推測されます。
実際には、汪楠の知人の一部が実行犯に含まれていたことが確認されているものの、汪楠自身が計画・指示した証拠は提出されていません。
今後予定されています控訴審では、こうした証拠や供述の不一致、捜査の偏り、汪楠の共謀があったか、などを含めて、改めて慎重に審理されることが期待されています。
当時、汪楠には事件を計画する動機は確認されていません。事件発生時、彼は出所者支援を行う会社の設立に取り組んでおり、さらに「ほんにかえるプロジェクト」や「プリズンライターズ」といった更生支援活動にも力を注いでいました。こうした社会的活動に取り組む中で、今回のような事態となってしまったことは、我々としても非常に残念です。
現在も汪楠は拘置所に勾留されていますが、本人は「自分は無実であり、必ず真実は明らかになる」と述べています。我々も彼の思いに寄り添い、控訴審での適正な判断が下されることを願っています。

Regarding the Verdict Wang Nan
On November 5, Wang Nan was sentenced to 13 years in prison.
He received a sentence equivalent to the heaviest penalty imposed on the actual perpetrators, on the grounds that he acted as the instigator in a robbery resulting in injury that occurred in an apartment in Ikebukuro.
For two years following his arrest, Wang Nan consistently denied any involvement in the case.
At the time of his arrest, police broke into his home by smashing a second-floor window in front of multiple cameras and took him into custody.
Because Wang Nan denied the allegations, he was subjected to “hostage justice”: he was held in solitary confinement for the entire two-year duration of the trial, and a complete ban on visits—including even letters—was imposed on everyone except his attorneys, putting him under severe psychological pressure.
During the trial, four of the actual perpetrators testified as witnesses. However, only one of them suggested Wang Nan’s involvement; the other three either denied or did not recognize any such involvement.
Despite this, the written judgment relied primarily on the testimony of that one individual, without sufficiently examining the other testimonies or alternative possibilities.
It is believed that investigative authorities, once Wang Nan’s name surfaced, prematurely concluded that the case was a “premeditated crime centered around Wang Nan,” and failed to pursue investigations from other angles.
Although it has been confirmed that some acquaintances of Wang Nan were among the perpetrators, no evidence has been presented showing that Wang Nan himself planned or directed the crime.
In the upcoming appeal trial, we hope that issues such as inconsistencies in testimony and evidence, investigative bias, and whether Wang Nan was truly involved in any conspiracy will be examined with renewed care.
At the time, no motive for Wang Nan to plan such a crime had been identified. He was working to establish a company providing support for people released from prison, and was also actively engaged in rehabilitation support initiatives such as the “Honni Kaeru Project” and “Prison Writers.”
Given these socially meaningful activities he was pursuing, we find it deeply regrettable that things have come to this situation.
Wang Nan remains detained in a detention center, but he states, “I am innocent, and the truth will surely be revealed.”
We stand with him in that belief and hope that an appropriate judgment will be rendered in the appeal trial.
